yeah, looks good so far up the nimitz. we have some roadwork in spots. we'll tell you more coming up. a wild chase ends with injuries and an arrest. cbs 5 reporter cate caugiran is in san francisco where the chp caught up with a suspected drunk driver. cate. >> reporter: michelle, yes, this is where it all ended. chp wasn't able to confirm all the details. but again what we can show you is that this chase ended in such a big mess. the traffic lights are out here at the intersection of 71th street and south van ness. a cyclist and multiple cars were involved but again, chp would not confirm that information. but what we do know is that officers tried to stop a driver in the mission district right around 2:00 this morning. the driver tried to flee from officers and then they say some sort of collision happened and that's when the officers arrested the driver and found out that that driver was under

the influence of alcohol. now, back out live, we see that city workers are again trying to do a lot of clean-up this morning here and try to restore those traffic lights in the area. a lot of debris and mess left behind and we saw one vehicle also in this area that has a dent in it. chp says this is an active investigation and there will be more information later on. cate caugiran, cbs 5. a house fire left a neighborhood in san francisco covered in smoke. cbs 5 reporter anne makovec on the scene with the clean-up. good morning. >> reporter: the people who lived in the building that was on fire have now been able to return home. they were lucky. here are the pictures of the

place in the duboce triangle. it was challenging for the firefighters because it was traveling through the walls of the building. the fire damage was isolated tonight try ways of the building. -- the damage was isolated to the entryways of the building. it could have been deadly if the smoke detectors didn't wake people up and get them out. >> some smoke coming out. i went back in and got my roommate and told them about it. >> reporter: firefighters say this fire was accidental. looks like it started in a wall heater. as far as the damage, they had to cut a hole in the roof. a lot of windows are broken and there is a lot of smoke damage but people can go back to their homes tonight, just one of the units the residents decided not to go back home because they are too traumatized. another good piece of news, no injury for anyone.

anne makovec, cbs 5. something went wrong when a group took its nightly walk in the east bay hills. a hiker fell to his death on the uc-berkeley campus. the man's body was found on the edge of the campus. the 20-year-old man disappeared while walking with friends. they called 911 about 6:30 last night. university police found his body about 200 feet down the steep ravine. foul play is not suspected but the death is under investigation. one of america's biggest cities is facing a serious safety problem. a shortage of police officers facing lower wages and benefits. more officers in san jose are now resigning. there are now less than 1,000 officers in the department available for full duty and just 583 officers are patrolling the streets in the steve in a city of 1 million people. >> you will be robbing peter to pay paul moving officers around. >> chuck reed says 44 men and

women are going through the academy right now. those officers should be ready to hit the streets next june and closing arguments are scheduled in martinez this morning in the case of a man who killed his ex-girlfriend and another man at the richmond/san rafael bridge toll plaza. this is the penalty phase in the trial of nathan burris who was convicted of the 2009 murders last week. he could potentially face the death penalty. two women home alone in marin county managed to fight off an armed prowler. officers say the suspect may have stab wounds in his chest. according to police, he broke into a san rafael apartment. he got into a fight with one woman. the other roommate grabbed a phone and called police. other neighbors say they heard yelling. >> kind of scary when you have young people in the house with you, too. >> the victim, who was being attacked, turned the knife on

the assailant. he ran away and police alerted nearby hospitals that the suspect may look for medical attention. daly city crews are racing to prevent the muddy mess from a water main break from getting worse. they call it weatherization. it includes stacking bales of hay and clearing out storm drains before the rain comes this week. the hay will contain the mud and keep it from doing any damage after tuesday's big mud slide. >> we'll look into the pipe with a camera and then excavate it out, and then based on that we can divert water to that location. >> it will take 7 weeks to fix the 8" cast iron pipe that broke. it's a mess out there. they're still mopping up. let's check weather again. the rain is acomin' but we have a little reprieve. >> this is it. it is time to weatherize as we are getting ready for the storm system to make its way in toward the bay area. it's been gorgeous the last few days and today probably another

nice day. but we'll notice some increasing cloud throughout the day. temperatures now a little chilly into fairfield. 39 degrees. 41 santa rosa. some patchy fog. 50 into oakland, 54 degrees in san francisco. storm clouds just off the coastline you see some of them right now. it will take the better part of the day for that to move onshore but we'll see clouds beginning to move in late in the day and then overnight tonight into tomorrow looks like rain making a return. so more clouds today. temperatures dropping off a little bit. we have 60s and some 70s yesterday. these numbers coming down a few degrees but still comfortable mainly in the mid- to upper 60s at least inland probably low 60s at the coastline but the raindrops are acomin', elizabeth. can't wait! >> bracing for tomorrow's commute, could be a wet friday commute. but right now things look good. we'll show you a nice spot. a live look at the south bay, san jose -- actually santa clara 101 at great america parkway where we sent our photographer this morning to show you a live look, moving

well into san jose. bay bridge roadwork on the upper deck. it's not much to slow you down at this time of the morning. but just a heads up. they usually wrap that up at 5 a.m. right now no delay approaching the pay gates. southbound 880 from embarcadero to jackson. northbound lanes on the golden gate bridge from the waldo north end of the tunnel to sir francis drake. traffic moves fine across the span of the golden gate bridge. and taking you out towards the east bay roadwork eastbound. brake lights in both directions through antioch right now. a quick look at bart. 24 bart trains all running on time. that's traffic, back to you guys. >> thank you. hearings are set to begin on capitol hill today to investigate the attack on the u.s. consulate in benghazi, libya. as susan mcginnis reports, the

witness list now includes former cia director david petraeus. reporter: after calls by congressional leadership, former cia director david petraeus will testify before congress tomorrow about the attack on the u.s. consulate in benghazi. >> good luck, sir. >> thank you. >> reporter: petraeus was scheduled to testify today before a house intelligence committee but those plans changed after he resigned following his admission of an affair with his biographer, paula broadwell. benghazi is at the center of another capitol hill battle. senate republicans say they will not accept the nomination of u.n. ambassador susan rice as a replacement for secretary of state hillary clinton. >> we will do whatever is necessary to block the nomination. >> reporter: senators john mccain and lindsey graham say rice was either lying or incompetent when she made this statement five days after the attack. >> we do not have information at present that leads us to conclude that this was premeditated or preplanned. >> reporter: president obama said the ambassador was

presenting the intelligence information she was given, to challenge those who attacked ambassador rice. >> if senator mccain and graham and others want to go after somebody, they should go after me. >> reporter: senator mccain accepted that offer. >> the president of the united states the commander-in-chief is the most responsible and i hope the president has no illusions about our view of his responsibility. >> reporter: mccain and graham want a watergate-style committee to investigate the benghazi attack. susan mcginnis, cbs news, washington. the military has suspended the security clearance for the woman at the center of the petreaus scandal. paula broadwell a former army intelligence officer who had high clearance. cbs news has learned the identity of the fbi agent who first brought the case to the bureau frederick humphries. he is a friend of florida socialite jill kelley. she went to him when she started getting harassing e- mails from broadwell.

4:40 now. san francisco sheriff says the move to recall him from office is purely political. a statement from ross mirkarimi says two people pushing for the recall have close ties to one of his opponents in his run for sheriff. mirkarimi says it would cost the city $3 million for a recall vote and he says that money would be better spent on domestic violence education and services. 4:40 now. looking brighter, how california could actually end one a budget surplus. >> plus, rough roads in a rich town. the affluent city littlessed as having some of the bumpiest streets in the bay area. >> and a small plane lands on a sacramento freeway. what went wrong and why did the pilot land here? we're going to tell you when we come back. ,,,,,,,,,,,,,,

the median on highway 65 near roseville. >> it's something you train for. you know, you find yourself when it actually happens, all that training comes back. >> and that's a good thing. so how did they get the plane off that highway? the most logical way. the pilot fixed the problem. chp shut down the traffic and the plane took off back to the airport dodging a few lights a couple of traffic signs but made it back. >> okay, can you imagine being on the highway and seeing this in your rear view mirror? >> or in front of you! >> a little scary. >> yeah. something like out of a james bond movie. >> love it. >> but those light poles were right there on the highway, too. that's a little scary to take off. >> we have some rain? >> i'm excited about it. i don't know about you but yeah, it's been nice around the bay area. today another decent day but some changes throughout the day. outside right now we have a mixture of clear skies at the bay, fog in the valleys,

temperatures mainly in the 40s and 50s. this afternoon expecting 60s so still another mild day but the clouds beginning to thicken up late in the day as that storm system grows a little bit closer. high pressure finally beginning to give way now. you can see some of that moisture moving up into southern california. the center of the low still off the coastline so we still have a ways to go here but eventually it's going to start to move in our direction. and that is going to open the door to not only this storm but another storm over the weekend and then some showers continuing on and off for quite some time. let's see if we can time it out. 4 a.m., mostly clear skies early on. as we head throughout the day today, the clouds begin to thicken up and as we look toward the evening staying dry. but still a lot of clouds outside. and then late tonight, a chance of showers overnight tonight. and into tomorrow morning. doesn't look like a real washout but probably getting wetter throughout the day on friday. so with that in mind, prepare for the rain looks like a decent day today though.

they just picked up some roadwork. in a connector ramp from westbound 92 to northbound 101 was shut down overnight but now everything is good to go and it looks good as well heading off of the high-rise heading out towards the east bay in hayward. let's go to the maps. other live traffic cameras. this is a look at the nimitz, 880 in oakland. this morning, more roadwork southbound 880 from embarcadero to jackson. it's not enough to impact your drive time. just a heads up if you have a flight to catch towards oakland airport. here's a look at the golden gate bridge. there's still some roadwork north of the span from the north end of the waldo tunnel all the way towards sir francis drake. but across the bay area every bridge itself, as you can see, it is still super light towards doyle drive and san francisco. in antioch this morning, this is the stretch of roadwork eastbound 4 somersville to contra loma. they will clear the scene around 6 a.m. that's a check of your opinion "timesaver traffic." back to you guys. in "your world this morning," police in southern israel say three people are

dead after a rocket attack from the gaza strip. the attack on an apartment building comes after israel launched a military operation this week on gaza which is governed by the palestinian militant group hamas. the operation began after previous rocket attacks on israel. palestinian officials say president abbas has cut short a trip to europe to deal with the crisis. she jen pink is the head of the communist party in china. he is the son of a party elder and has been china's vice president for the past five years. as the head of the communist party he will lead china's military and economy. 4:47 now. the bp oil company is expected to admit criminal misconduct in connection with the massive 2010 oil leak in the gulf of mexico. several sources say bp and the u.s. justice department have agreed on a plea deal and details could be announced as soon as today. the company will reportedly acknowledge some type of

criminal behavior and is expected to pay a record fine. today's scheduled hearing for colorado mass shooting suspect james holmes has been postponed. holmes' attorney requested the delay after his client was taken to a hospital for an unspecified injury yesterday. holmes is accused of killing 12 people, wounding 58 at an aurora movie theater back in july. cancer charity "livestrong" foundation is formally dropping founder lance armstrong from its name. the cycling legend stepping down as the chairman and resigned from the board of directors because of accusations that he used performance-enhancing substances. armstrong decided to stop fighting the u.s. anti-doping agency and has since been stripped of his 7 tour de france titles. president barack obama is going to new york city today to see the devastation from superstorm sandy. the president will tour the city's hardest hit borough, staten island. the president toured new jersey

shortly after sandy hit. but mayor michael bloomberg asked the president to stay away from new york. he said then that the president's visit would take up too many resources. president obama says he is willing to work with republicans on capitol hill to stop automatic budget cuts and tax hikes from kicking in at the end of the year. investors are looking for progress on a deal to stop the u.s. from falling off the so- called "fiscal cliff." also today, traders will get a look at new unemployment numbers from washington. here's a shocker. california may soon have a budget surplus. the legislative budget analyst says the deficit will be about $1.9 billion this fiscal year and we could see a surplus by the year 2014. it was just a few months ago we were talking about a $16 billion deficit. >> we have to pay down our debt, borrowed from the schools, from the redevelopment fund. governor schwarzenegger's economic recovery bond. we borrowed from the people. we borrowed from local

bad streets. but when it comes to potholes, one very affluent community in bay area is the king of the road. a new report from the metropolitan transportation commission says larkspur has the worst roads in the bay area. it's tied for last with st. helena in sonoma county. city leaders say communities need to tax themselves to repair the roads and larkspur, apparently, hasn't done that. >> same monies are also the monies we use to protect citizens from stormwater issues and slides. competing demands are really difficult. >> city leaders say they may try to put a revenue measure before the voters to fix those roads. in other bay area headlines on this thursday, a new warriors arena is now one step closer to being built here in san francisco. a supervisor's committee said the billion-dollar project appears to be fiscally feasible. if the full board agrees next week, the planning process can move forward. one possible roadblock, some people who live near the

waterfront site are concerned about the traffic and noise that could come from 200 events at the arena. an issue of allowing tiny apartments in san francisco going before the planning commission this afternoon. the apartments would be as small as 220 square feet. the board of supervisors wants to set a limit on how many of those can be built in the city. but the planning staff wants the cap dropped. >> i can't imagine 220 square feet. >> that's a shoe box. >> pretty small. >> i think your toilet is in your shower.
